These Terms of Service apply to posimatiq.com and related apps operated by Tomatiq Research SL (the “Company”).

By using the Services, you agree to these Terms. If you violate these Terms, the Company may suspend or terminate your access to the Services.

The Company may update these Terms from time to time. If the update is significant, the Company will update the date at the top of this page and, where appropriate, provide notice through the Services.

Definitions

“Services” means posimatiq.com and any website, web app, mobile app, or related digital service created and maintained by the Company.

“You” and “your” mean the person or organization using the Services.

“Account” means an account created in one of the Company apps.

“Content” means information, text, files, data, or other material submitted, created, or stored by you in the Services.

Account Terms

  1. You are responsible for keeping access to your account secure.

  2. Some Services allow anonymous accounts. These accounts use an automatically generated username and a passkey. A passkey is a device-based sign-in method approved on your device by Face ID, fingerprint, or PIN. The Company does not receive your Face ID, fingerprint, or PIN.

  3. Some Services require an email address to create an account. This is used to let you access the same account from different devices and, where necessary, receive account-related messages.

  4. You are responsible for all activity that happens under your account.

  5. You must not use the Services for unlawful activity, abuse, harassment, spam, fraud, attempts to disrupt the Services, or attempts to gain unauthorized access to any account, system, or data.

  6. You must not misuse automated tools, bots, scrapers, or agents in a way that disrupts the Services, bypasses access rules, or violates these Terms.

Payment, Refunds, and Plan Changes

  1. posimatiq.com does not process payments.

  2. The website does not use Stripe or any other payment provider.

  3. If the Company later offers paid Services, the applicable price, payment terms, tax treatment, cancellation terms, and refund terms will be provided before payment is required.

  4. Free Services are provided without requiring payment details.

Cancellation and Termination

  1. You may stop using the Services at any time.

  2. If a Service provides account deletion, you are responsible for following the account deletion process provided in that Service.

  3. The Company may suspend or terminate access to the Services if you violate these Terms, create security risks, abuse the Services, or use the Services unlawfully.

  4. When an account is deleted, account data may be deleted or made inaccessible, subject to technical limits, backup retention, security needs, abuse prevention, and legal obligations.

  5. The Company may refuse access to the Services where necessary to protect the Services, other users, or the Company.

Modifications to the Service and Prices

  1. The Company may modify, limit, suspend, or discontinue any part of the Services.

  2. The Company may add, remove, or change features.

  3. The Company may change free or paid plans in the future. If a change affects an existing paid Service, the Company will provide notice where required.

Uptime, Security, and Privacy

  1. The Services are provided on an “as is” and “as available” basis.

  2. The Company does not promise that the Services will be uninterrupted, error-free, or permanently available.

  3. The Company takes reasonable steps to protect the Services, but no digital service can be guaranteed to be completely secure.

  4. The Company may temporarily restrict access if usage creates security, reliability, abuse, or performance risks.

  5. The Company processes data as described in the Privacy Policy and Cookie Policy.

Copyright and Content Ownership

  1. You retain ownership of Content that you submit, create, or store in the Services.

  2. You give the Company the limited permission needed to host, process, transmit, display, and otherwise use your Content only as necessary to provide and maintain the Services.

  3. You are responsible for ensuring that your Content does not violate the rights of others or applicable law.

  4. The Company may remove Content or restrict access to Content if it violates these Terms, violates the law, creates security risks, or creates abuse risks.

  5. The Company owns or licenses the Services, including their software, design, text, graphics, logos, and other materials, except for Content owned by users or third parties.

  6. You may not copy, sell, resell, exploit, or reuse any part of the Services except as permitted by law or with written permission from the Company.

Services Adaptations and API Terms

  1. Unless the Company publishes specific API documentation, the Services do not include a public API.

  2. You must not access the Services through unofficial automated methods if that access disrupts the Services, bypasses normal access controls, extracts data without permission, or violates these Terms.

  3. If the Company provides an API in the future, use of that API may be subject to additional API terms.

  4. The Company is not responsible for third-party tools, integrations, clients, agents, or services that access or interact with the Services.

Liability

  1. To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services.

  2. The Company is not liable for loss of data, loss of profits, loss of business, service interruption, unauthorized access, or actions of third parties, except where liability cannot be excluded under applicable law.

  3. Nothing in these Terms limits liability that cannot legally be limited.
